Article 247 of Bankruptcy Law

If a decision to commence bankruptcy declaration proceedings in respect of the buyer is issued before payment of the price, and the goods remain with the seller, or the goods have not yet entered the warehouses of the buyer or the warehouses of its agent instructed to sell them, or the seller has not transferred the securities, shares or real estate into the buyer’s name, the seller may retain the aforementioned assets or recover possession of those of which it relinquished possession for the purpose of delivering them to the buyer, and rescind the sale contract. Nevertheless, the goods may not be recovered if they have lost their identity or if, before their arrival, the debtor disposed of them without fraud pursuant to a document of title or transport document. In all cases, the trustee or the debtor may, after obtaining permission from the bankruptcy judge, request performance of the sale contract, provided that the agreed price is paid to the seller. If the trustee does not request this, the seller may assert its right to rescission and claim compensation—if there are grounds for it—and participate with that claim in the bankruptcy declaration proceedings.
