Article 131 of Commercial Code

1 - If the seller fails to deliver at the time fixed therefor, the contract shall be deemed rescinded without need for formal notice, unless the buyer notifies the seller that he insists on performance of the contract within three days of that time falling due. 2 - The buyer may claim from the seller, by way of compensation, the difference between the agreed price and what he paid in good faith to obtain a similar thing. - If the thing sold consists of goods having a known market price, the buyer may, even if he has not purchased similar goods, claim from the seller the difference between the agreed price and the market price on the day fixed for delivery.
