Article 146 of Commercial Code

1 - The seller shall send the buyer, without delay, a clean, negotiable bill of lading relating to the goods sold. It must contain evidence that the goods were loaded on board the vessel on the date or within the period specified for shipment, and must confer on the buyer or his representative the right to take delivery of the goods, by endorsement to him or by transfer of that right to him by the appropriate legal means. If the bill is a received-for-shipment bill, it must be marked by the carrier company on the date of shipment to indicate completion of loading the goods on board the vessel. 2 - A bill of lading shall be considered clean if it does not contain express additional conditions affirming the necessity of defects in the thing sold or in the manner of its packing. Such conditions do not include a reference in the bill of lading to prior use of the containers or packaging, to non-liability for damage occurring because of the nature of the thing sold, or to the carrier's lack of knowledge of the contents or weight of the packages. - The bill of lading shall be accompanied by a list of the goods sold and the insurance policy, or a certificate replacing it, containing its essential terms and conferring on its holder the same rights established by the policy. It shall likewise be accompanied by the other documents that the buyer may request to establish that the goods conform to what the contract stipulates. If the bill of lading refers in certain matters to the charterparty, a copy of that contract must be attached.
