Article 16 of Commercial Code

1 - Government ministries, the municipality, associations, and clubs shall not be considered traders, but commercial transactions undertaken by these bodies shall be subject to the provisions of the Commercial Law. 2 - Trader status shall attach to companies established or owned by the State and other public bodies, public institutions primarily engaged in commercial activity, and establishments belonging to a foreign state that conduct commercial activity in Kuwait. The provisions arising from trader status shall apply to all these bodies unless the law provides otherwise.
