Article 163 of Kuwaiti Penal Code

Anyone who commits a minor act of assault which does not reach, in its gravity, the level of the acts stipulated (1) Repealed pursuant to Decree-Law No. 70 of 2025 Index of the Law Home page 132 Kuwaiti Penal Code Law No. 16 of 1960 Promulgating the Penal Code and its Amendments in the preceding articles shall be punished by imprisonment for a term not exceeding three months and a fine not exceeding twenty-two dinars and five hundred fils, or either of these two penalties. Article 164 (1) Anyone who unintentionally causes a wound to anyone or inflicts tangible harm upon him, where this arises from recklessness, dereliction, negligence, inattention, failure to observe laws and regulations, or his breach of the requirements imposed by the standards of his office, profession or trade, shall be punished by imprisonment for a term not exceeding one year and a fine not exceeding five hundred dinars and not less than two hundred and fifty dinars, or either of these two penalties. Article 164 bis (2) The injury mentioned in the preceding article shall be punished by imprisonment for a term not exceeding two years and a fine not exceeding one thousand dinars and not less than five hundred dinars, or either of these two penalties, if accompanied by any of the following circumstances: 1- The offender's consumption of an intoxicating, narcotic or psychotropic substance or any other substance affecting a person's natural faculties. 2- If the offender's act results in injury to two or more persons. 3- If the offender's act results in the victim sustaining a permanent disability. 4- The offender's refusal or neglect, at the time of committing the act, to assist the victim while being capable of doing so. The penalty shall be imprisonment for a term not exceeding three years and a fine not exceeding two thousand dinars and not less than one thousand dinars, or either of these two penalties, if two or more of the circumstances stipulated in the preceding paragraph are present together.
