Article 221 of Kuwaiti Penal Code

Theft shall be punishable by imprisonment for a term not exceeding three years and a fine not exceeding two hundred and twenty-five dinars, or either of these two penalties, if accompanied by any of the following circumstances: First: If the theft occurs in an inhabited place, a place intended for habitation, or its appurtenances. Second: If the theft occurs in a place intended for worship. Third: If the theft concerns an item being carried by a means of land, sea or air transport, an item deposited in a warehouse for the safekeeping of such items, or an item considered part of a seaport or airport. Fifth: If the theft occurs at night. Sixth: If the theft occurs while carrying a weapon, openly or concealed, or is committed by two or more persons. Seventh: If the theft is committed by a servant to the detriment of his master, or by a worker or employee in the place where he ordinarily works.
