Article 234 of Kuwaiti Penal Code

Fraud shall be punishable by imprisonment for a term not exceeding two years and a fine not exceeding one hundred and fifty dinars, or either of these two penalties, in the following two cases: First: If the victim was already obliged or intending to hand over property in his possession, and the perpetrator induced him through deception to hand over to him, or to another person, property of greater value. Second: If the offender and the victim were parties to a contract, and the offender used deception during the conclusion or performance of the contract to obtain terms or advantages greater than those he would have obtained without such deception.
