Article 235 of Kuwaiti Penal Code

Anyone managing a commercial, industrial or agricultural enterprise whose capital consists wholly or partly of public subscriptions through shares, bonds or any other type of securities, who commits fraud intended to deceive the public into subscribing or delivering to him, for the account of the enterprise, any property whatsoever, whether by publishing an incorrect balance sheet or account, by falsifying the enterprise's papers, documents or books, or by making false statements concerning material matters capable of misleading the public in such a manner that it cannot ascertain the facts from other sources, shall be punished by imprisonment for a term not exceeding five years and a fine not exceeding three hundred and seventy-five dinars, or either of these two penalties, even if his fraud does not result in his obtaining any property whatsoever from the public.
