Article 18 of Oil Sector Labour Law

Without prejudice to acquired rights, the worker shall be entitled, upon expiry of the contract term, or upon termination by the employer in contracts of indefinite duration, to a gratuity for his service calculated on the basis of (30) thirty days for each year of service for the first five years and the wage for (45) days for each year of the following years. The worker shall be entitled to a gratuity for fractions of a year in proportion to the part thereof spent at work, and the wage shall be taken as the basis for calculating the gratuity. The worker may, after notifying the employer pursuant to the preceding Article, resign from work in this case half the gratuity referred to in the preceding paragraph if his period of service exceeds two years and has not reached five years, and three quarters thereof if this period exceeds five years and has not reached ten years. The worker shall be entitled to the gratuity if he resigns after ten years of continuous service, provided that the provisions of this Article shall apply to Kuwaiti workers from the date they joined the work, while, as for others, its provisions shall apply to them from the date of issuance of this Law, all without prejudice to the provisions of Article 57 of Law No. 38 of 1964.
