Article 293 of Code of Civil Procedure

The application for imprisonment shall be submitted to the Director of the Enforcement Department or one of the judges assisting him, accompanied by a copy of the writ of execution and its notice of service. Before issuing the order, the issuing judge may conduct a summary investigation if the documents supporting the application are insufficient for him, and may, for that purpose, obtain the necessary documents from governmental and non-governmental bodies to determine the application. The issuing judge may grant the debtor a period for payment not exceeding one month. He may also, after obtaining the creditor’s consent, order payment of the debt by instalments whenever it is established to his satisfaction that the debtor is unable to pay it in full but is able to pay it in parts. The order permitting payment by instalments shall be deemed never to have existed if the debtor fails to pay any instalment on its specified due date. A grievance against the order shall be made in the manner set out in the chapter concerning orders on petitions, and shall be treated as a grievance against non-contentious orders issued by the President of the Court of First Instance.
