Article 293 مكرر of Code of Civil Procedure

The Director of the Enforcement Department or any of the judges assisting him shall, upon a petition submitted by the creditor 1( Added pursuant to Decree-Law No. 59 of 2025. 2( Amended pursuant to Decree-Law No. 59 of 2025. 3( Added pursuant to Decree-Law No. 59 of 2025. holding the final judgment, final payment order or final order on petition, issue an order for the arrest and production of the debtor and his imprisonment for a period not exceeding six months if he refuses to comply with a final judgment, final payment order or final order on petition despite his established ability to pay. The person issuing the order shall specify the period of imprisonment and whether it is to be served in one continuous period or in separate periods. A claim of inability to pay shall not be accepted from a debtor under any of the instruments referred to in the first paragraph if he has disposed of or concealed his assets with the intention of harming the creditor and it has become impossible for the creditor to enforce against those assets. )1(
