English translation
Upon the defendant's application, the action may be deemed never to have been brought if the defendant has not been summoned to appear within ninety days from the date of submission of the statement of claim to the Registry and this is attributable to an act of the plaintiff.

يجوز بناءً على طلب المدعى عليه اعتبار الدعوى كأن لم تكن إذا لم يتم تكليف المدعى
عليه بالحضور خلال تسعين يوماً من تاريخ تقديم الصحيفة إلى إدارة الكتاب وكان
