Article 60 of Code of Civil Procedure

In actions in which the judgment is final, if the defendant alone fails to appear at the first hearing or to submit a memorandum of defence, and has not been personally served, the court must adjourn consideration of the action to a subsequent hearing of which the plaintiff shall serve notice on him. The defendant shall be considered personally served even if he refuses to receive a copy of the notice or sign acknowledging receipt, provided that the procedures stipulated in the fourth paragraph of Article Nine have been followed. If there are multiple defendants in the aforementioned actions, some of whom have been personally served and others have not, and all fail to appear at the first hearing or submit a memorandum of defence, or those not personally served fail to do so, the court must adjourn consideration of the action to a subsequent hearing of which the plaintiff shall serve notice on those absent who have not been personally served. If the defendant in the cases stipulated in the preceding two paragraphs has been served through the Public Prosecution pursuant to Article 11/2 of this Law, or if the defendant is a governmental body or a public legal person, service shall not be repeated.
