English translation
If, in the defendant's absence, the court finds that service of the statement of claim on him was invalid, it must adjourn the action to a subsequent hearing of which the plaintiff shall serve notice on him. If, in the plaintiff's absence, it finds that he did not have legal notice of the hearing, it must adjourn the action to a subsequent hearing of which the registry shall serve notice on him.

إذا تبينت المحكمة عند غياب المدعى عليه بطلان إعلانه بالصحيفة وجب عليها
تأجيل الدعوى إلى جلسة تالية يعلنـه بهـا المدعي .
وإذا تبينت عند غياب المدعي عدم علمه بالجلسة قانوناً وجب عليها تأجيل الدعوى
