Without prejudice to the measures prescribed in this Law or to any more severe penalty under any other law. Anyone who drives or attempts to drive a vehicle while under the influence of intoxicating beverages, narcotics, psychotropic substances, drugs carrying a warning against driving under their influence, or any other substance affecting a person's natural faculties shall be punished by imprisonment for a term not exceeding two years and not less than one year and a fine not exceeding three thousand Kuwaiti dinars and not less than one thousand Kuwaiti dinars, or by either of these two penalties. The punishment shall be imprisonment for a term not exceeding three years and not less than one year and a fine not exceeding three thousand Kuwaiti dinars and not less than two thousand Kuwaiti dinars, or either of these two penalties, if the act referred to in the preceding paragraph results in an accident resulting in damage to public property or the property of others. The punishment shall be imprisonment for a term not exceeding five years and not less than two years and a fine not exceeding five thousand Kuwaiti dinars and not less than two thousand Kuwaiti dinars, or either of these two penalties, if the act referred to in the second paragraph results in an accident leading to injury or death. The court shall order the withdrawal of the driving licence for a period of not less than one year and not exceeding three years. In the event of recidivism, the court may order its withdrawal for a period of not less than three years and not exceeding five years. )2(

مــع عــدم الإخلال بالتــدابير المقــررة في هــذا القانــون أو بأيــة عقوبــة أشــد في أي قانــون
آخــر.
يعاقــب بالحبــس مــدة لا تزيــد على ســنتين ولا تقــل عــن ســنة وبغرامــة لا تزيــد على ثلاثــة
آلاف دينــار كويتــي ولا تقــل عــن ألــف دينــار كويتــي أو بإحــدى هــاتين العقوبــتين كل
مــن قــاد أو حــاول قيــادة مركبــة وهــو تحت تــأثير المشروبــات المســكرة، أو المخــدرات، أو
المؤثــرات العقليــة ،أو عقــاقير محــذر مــن القيــادة تحــت تأثيرهــا أو أيــة مــادة أخــرى تؤثــر
في قــوى الشــخص الطبيعيــة.
ويعاقــب بالحبــس مــدة لا تزيــد على ثلاث ســنوات ولا تقــل عــن ســنة وبغرامــة لا تزيــد
على ثلاثــة آلاف دينــار كويتــي ولا تقــل عــن ألــفين دينــار كويتــي أو بإحــدى هــاتين
العقوبــتين في حــال نتــج عــن الفعــل المشــار إليــه في الفقــرة الســابقة حــادث نتــج عنــه
تلفيــات بالممتلــكات العامــة أو الــغير.
ويعاقــب بالحبــس مــدة لا تزيــد على خمــس ســنوات ولا تقــل عــن ســنتين وبغرامــة لا
تزيــد على خمســة آلاف دينــار كويتــي ولا تقــل عــن ألــفين دينــار كويتــي أو بإحــدى هــاتين
العقوبــتين في حــال نتــج عــن الفعــل المشــار إليــه في الفقــرة الثانيــة حــادث أدى إلى إصابــة
أو وفــاة.
وتأمــر المحكمــة بســحب رخصــة الســوق مدة لا تقــل عن ســنة ولا تجاوز ثلاث ســنوات
وفي حالــة العــود للمحكمــة أن تأمــر بســحبها مــدة لا تقــل عــن ثلاث ســنوات ولا تجــاوز
