Article 9 of Press and Publications Law

No newspaper may be issued without obtaining a licence for that purpose from the competent Ministry. A licence shall be granted only to the owner of an establishment or company. If the newspaper is a daily, the capital of the establishment or company must be no less than two hundred and fifty thousand dinars. Without prejudice to the provisions of Law No. 15 of 1960 AD concerning Commercial Companies and the laws amending it, the competent Ministry shall appoint an auditor to audit and state the financial position of the accounts of the establishment or company licensed to issue a newspaper, in accordance with the regulations and controls issued by a decision of the competent Minister. The licence application shall be submitted to the competent Ministry and shall include the following particulars: 1 - The licence applicant's name, date of birth, most recent academic qualification obtained, and place of residence. 2 - If the licence applicant is a company, the names of all members of its board of directors and its management headquarters shall be stated in the application. (1) Amended by Law No. 17 of 2020 Index of the Law 521 Home Page Printing and Publications Law Law No. 3 of 2006 concerning Printing and Publications 3- The proposed name of the newspaper, its publication dates, format and purpose, whether political, social, cultural, artistic or otherwise, and the language in which it is issued. The newspaper's name may not be identical to the name of a newspaper that preceded it in publication and whose licence remains valid. 4- The address of the newspaper's management headquarters and its place of printing. With the approval of the competent Ministry, one or more supplements to the newspaper may be issued on the same day on which it is issued. This approval must be obtained before publication.
