Article 37 of Electronic Transactions Law

Without prejudice to any more severe penalty prescribed in another law, imprisonment for a term not exceeding three years and a fine of not less than five thousand dinars and not more than twenty thousand dinars, or either of these two penalties, shall be imposed on anyone who: Law Index 580 Home Page Electronic Transactions Law Law No. 20 of 2014 concerning Electronic Transactions 1- Intentionally accesses an electronic processing system without right, disrupts access to that system, causes its destruction, or obtains numbers or data of credit cards or other electronic cards to use them to obtain the funds of others. 2- Issues an electronic certification certificate or practises any electronic certification services without obtaining a licence therefor from the competent authority. Confiscation of the tools, software or devices used in committing the offence may be ordered, without prejudice to the rights of third parties acting in good faith. In all cases, publication of a summary of the final judgment of conviction in two daily newspapers published in Arabic shall be ordered at the convicted person's expense. It shall also be published on the open electronic communications network in accordance with the rules specified by the Executive Regulations. The penalty shall be doubled in the event of recidivism in committing any of these offences.
