Article 2 of Law Establishing the Constitutional Court

The Constitutional Court shall be composed of five counsellors selected by the Judicial Council by secret ballot. It shall also select two alternate members, and they must be Kuwaitis. A decree shall be issued appointing them. If the seat of any regular or alternate member becomes vacant, the Judicial Council shall select, by secret ballot, a replacement, whose appointment shall be by decree. The regular and alternate members of the Court shall perform their work therein alongside their original work in the Cassation Circuit or the High Court of Appeal.
