English translation
The expert shall hear the statements and observations of the litigants and shall hear—without an oath—the statements of anyone he considers should be heard. If a litigant fails without excuse to comply with the expert’s decisions, the expert shall resort to the court for it to impose on him a fine of not less than fifty dinars and not more than one hundred dinars, by a decision entered in the hearing minutes, having the same enforceability as judgments and not subject to challenge by any means. This judgment shall be enforced after the person against whom it was rendered has been notified by registered letter from the Registry, accompanied by a copy of the operative part of the said judgment. In this case, the court may declare that the litigant who failed to comply with the expert’s decisions has forfeited his right to rely on the judgment appointing the expert.

يسمع الخبير أقوال الخصوم وملاحظاتهم ويسمع - بغير يمين – أقوال مـن يــرى
هو سماع أقواله وإذا تخلف الخصم عن تنفيذ قرارات الخبير بغير عذر لجأ الخبير إلى
المحكمة لتحكم عليه بغرامة لا تقل عن خمسين دينارا ولا تزيد على مائة دينار وذلك
بقرار يثبت في محضر الجلسة، له ما للأحكام من قوة تنفيذية، ولا يقبل الطعن بأي
طريق، ويكون تنفيذ هذا الحكم بعد إخطار المحكوم عليه بكتاب مسجل من إدارة
الكتاب مرفقا به صورة من منطوق الحكم المذكور، وللمحكمة في هذه الحالة أن
تقرر بسقوط حق الخصم الذي تخلف عن تنفيذ قرارات الخبير في التمسك بالحكم
