Article 21 of Judicial Organisation Law

Promotion of judges up to the first grade and of members of the Public Prosecution of equivalent status shall be based on seniority coupled with fitness. Otherwise, promotion to other posts shall be by selection. In all cases, promotion may only be to the immediately following grade, provided that the candidate for promotion has obtained two consecutive reports in which his competence rating is not less than above average. A judge or a member of the Public Prosecution may be passed over for promotion in any of the following cases: a - If he has been censured by the Disciplinary Council. b - If he has been given a written warning pursuant to Articles (36,65) of this Law. c - If he has not passed the training courses in accordance with the rules and conditions laid down by the Supreme Judicial Council in this regard.
