Article 3 of Anti-Human Trafficking Law

Without prejudice to any more severe penalty stipulated by another law, anyone who smuggles migrants in the manner specified in Article 1 of this Law shall be punished by imprisonment for a term not exceeding ten years and a fine of not less than three thousand dinars and not more than ten thousand. The penalty shall be imprisonment for a term not exceeding fifteen years and a fine of not less than ten thousand dinars and not more than twenty thousand dinars if the crime is accompanied by any of the following circumstances: 1 - If it is committed through an organised criminal group which the accused participated in establishing, organising or managing, in which he assumed a leadership role, or which he joined with knowledge of its purposes. 2 - If the crime is transnational in nature. 3 - If it is committed by two or more persons or by a person carrying a visible or concealed weapon. 4 - If the accused is a public official in the State and exploits his position to commit the crime, or if the accused has standing or influence with entities connected with foreigners' entry into it or passage across its borders or through its ports. 5 - If a forged travel document or identity document is used in its commission.
