The sentence of imprisonment or fine imposed shall not be less than half its maximum if the offence is accompanied by any of the following circumstances: 1: Commission of the offence through an organized gang. 2: The offender holding public office and committing it by exploiting his authority or influence. 3: Deceiving or exploiting minors and persons of equivalent diminished capacity. لا تقل عقوبة الحبس او الغرامة التي يحكم بها عن نصف حدها الأقصى إذا اقترنت
الجريمة بأي من الظروف الآتية :
۱ : ارتكاب الجريمة من خلال عصابة منظمة.
۲ : شغل الجاني وظيفة عامة وارتكابه لها مستغلا سلطته أو نفوده.
۳ : التغرير بالقصر ومن في حكمهم من ناقصي الأهلية أو استغلالهم.
٤ :- صدور أحكام سابقة من المحاكم الوطنية، أو الأجنبية بموجب الاتفاقيات
