A collective investment scheme means any of the following forms: 1 - An investment fund having legal personality. 2 - A contractual collective investment scheme relating to movable or immovable assets, the purpose of which is to enable persons participating in this scheme to participate in or obtain profits that may arise from the possession, ownership, management or disposal of those assets. - Whatever the Authority determines falls within a collective investment scheme. The Authority shall establish the rules regulating collective investment schemes, taking into account the provisions of the articles of this Chapter of the Law.

يقصد بنظام الاستثمار الجماعي أي من الصور التالية :-
۱ - صندوق استثمار يتمتع بالشخصية الاعتبارية.
۲ - نظام استثمار جماعي تعاقدي يتعلق بالأصول المنقولة أو غير المنقولة، يكون
الغرض منه تمكين الأشخاص المشاركين في هذا النظام من المشاركة أو الحصول
على الأرباح التي قد تنشأ عن حيازة أو امتلاك أو إدارة أو التصرف في تلـك
الأصول.
- ما تقرر الهيئة أنه يندرج ضمن نظام الاسـتثمار الجماعي.
وتضع الهيئة القواعد المنظمة لأنظمة الاستثمار الجماعي مع مراعاة أحكام مواد
