Article 70 of Telecommunications Regulatory Authority Law

a - Anyone who intentionally misuses means of telephone communication shall be punished by imprisonment for a term not exceeding a year and a fine not exceeding two thousand Kuwaiti dinars and not less than two hundred dinars, or either of these two penalties. b - Anyone who, by any means of communication, sends threatening or insulting messages or messages contrary to morals, or transmits a different piece of news with the intent to cause panic, shall be punished by imprisonment for a term not exceeding two years and a fine not exceeding five thousand dinars, or either of these two penalties. c - Anyone who intentionally abuses and defames another by using a device or means of communication or otherwise to capture one or more images or a video clip of him without his knowledge or consent, exploits the capabilities of these devices and extracts images from them without his permission, or fabricates an image of other persons offensive to public morals, shall be punished by imprisonment for a term not exceeding two years and a fine not exceeding five thousand dinars, or either of these two penalties. d - Anyone who, through communication devices or means, sends the images described in the preceding paragraph or any image or video clip offensive to public morals to other persons, or publishes or circulates them by any means whatsoever, shall be punished by imprisonment for a term not exceeding three years and a fine not exceeding five thousand dinars and not less than five hundred dinars, or either of these two penalties. e - If the acts referred to in items c - d of this article are accompanied by threats or blackmail, or involve exploiting the images by any means to offend modesty, impugn honour or incite vice and debauchery, the penalty shall be imprisonment for a term not exceeding five years and a fine not exceeding ten thousand dinars and not less than one thousand dinars, or either of these two penalties. f - Anyone who provides or participates in providing communications services contrary to public order or public morals shall be punished by the penalties stipulated in item b of this article, in addition to the application of the provisions stipulated in Article 35 of this Law. In all cases, confiscation of communication devices and means and other items used in committing the offence shall be ordered, as shall the erasure and destruction of the images and video segments obtained.
