Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 192

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The rule established in the Maliki school that a legally competent father may marry off his adult virgin daughter compulsorily without her consent. The legislature’s departure from it in Law 51/1984 to require a wife between natural puberty and completion of her twenty-fifth year to participate with her guardian in choosing the husband. Its implication: a marriage contracted by this wife’s guardian is a valid marriage whose implementation is suspended pending her ratification and is invalid if she does not ratify it.
