State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Conclusion of a valid marriage. Its condition. Offer by the wife's guardian and acceptance by the husband or those acting in their stead. - The statutory provision being unrestricted in specifying who has guardianship to conclude the marriage contract of a virgin between puberty and completion of twenty-five, or a previously married woman who has reached twenty-five. Its implication. There is no basis for qualifying it. Construing it as specifying guardians for marrying off a virgin between puberty and twenty-five. Incorrect. The reason for this: the legislature's intention was not directed to that specification. - The legislature's intention being directed to identifying the guardian. Its implication. This must be expressly provided for in a specific place in the law. Articles 8, 29 and 30 of Law 51/1984 concerning personal status.
