Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 748

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The established rule under the school of Imam Malik, in the event of separation between spouses by irrevocable divorce, is that establishment of lineage requires the wife to give birth to the child within one year of the divorce and not to have acknowledged the expiry of the waiting period. The blood test’s conflict with the Sharia rule establishing lineage by the marital bed renders it unproductive in the action.
