Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 105

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An administrative decision. Its contravention of the law strips it of its administrative character. - Cause is an essential element in the formation of an administrative decision. It must rest on a factual or legal situation that prompts the administration to intervene to produce a legal effect in pursuit of the public interest. - Stating the cause of an administrative decision. Not necessary. Stating reasons for it brings it within the scope of legal review by the administrative judiciary to verify the lawfulness of the cause, without extending to the sphere of expediency vested in the administrative authority.
