State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Specialist positions are engineering positions requiring a university qualification for appointment. Support positions are positions of an engineering nature requiring a qualification below university level or a training course for appointment. Article 1 of Civil Service Council Decision 7 of 2001. - Allocation of a percentage of 20% for promotion by selection of holders of engineering support positions across the various grades and programmes. Article 1 of the Minister of Electricity's Decision 26/2007. Its meaning: confining that percentage to holders of engineering support positions as defined in the aforementioned Civil Service Decision. Its implication and necessary consequence: no preference may be accorded to holders of a university qualification at the expense of holders of support positions when promotion by selection concerns holders of those positions. The reason therefor. The challenged judgment's departure from this view vitiates it for violation of the law.
