English translation of the principle

The absence in Law No. 7 of 1960 of provision for payment of a cash allowance to an employee for accumulated leave upon termination of his service. Its effect. The Government is not liable for any such allowance. It may not be argued that the rationale of the legislation is to expand employees’ rights beyond those they had under the repealed law. Rationale thereof. Provisions may not be interpreted expansively if their meaning is clear and plain. - Leave allowance upon termination of service. No change in the legislative rule concerning it and the enactment of Law 46 of 1965. The maximum that may be paid to the employee is his entitlement for three months, without exceeding that amount, for periodic leave accumulated during the last five years.
