Kuwait Court of Cassation principle number 1025

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The indictment is an official procedural document in the litigation. The effect thereof. It must be signed by the person having capacity to issue it. The rationale and effect thereof. Its lack of signature results not only in its nullity but also in the court not being seised thereof. The judgment's contravention of this. Its effect. Absolute nullity of the judgment and what is based upon it, relating to public order. In this case the Court of Appeal may not address and decide the merits of the case. Its judgment must be confined to declaring the appealed judgment void and the proceedings inadmissible until the conditions for their admissibility are satisfied.
