State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments issued in civil actions by criminal courts. May be appealed. Whenever they would be appealable had they been issued by civil courts. Article 200, Criminal Procedures and Trials. - Challenging judgments issued during the course of the action that do not terminate the dispute. Not permissible. Except after issuance of the judgment terminating the entire dispute. Article 128, Procedure. - The Criminal Court's failure to decide the civil action and its relinquishment of it to the competent civil court. A judgment that may not be appealed or challenged by cassation. The reason for this: where the avenue of appeal is closed, a challenge by cassation is, a fortiori, impermissible. Example.
