Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 808

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Criminal proceedings in felonies lapse upon the passage of ten years from the date of commission of the offence. - The running of that period is interrupted by any charging, investigation or trial procedure, whether in the presence or absence of the accused, and also by inquiries if conducted in the presence of the accused or if he is notified - 287 - Criminal Procedures and Trials thereof officially. The rationale: the presumption that proceedings are forgotten through the passage of time without procedures being taken therein; once such procedures are taken, they become present in minds and the rationale for extinction ceases to exist. The challenged judgment's contravention of this view. An error in the application of the law requiring its cassation. Example.
