Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 810

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

What determines the characterization of an incident as a felony or misdemeanor—in relation to limitation rules—is the characterization reached by the court, not the characterization under which the action was brought or that in the charging decision. - The court's rejection of the appellant's plea that the criminal action was time-barred, in conformity with the correct application of the law. The appellant's challenge in this regard is unsound. - An example of a sound response in an offence of issuing a cheque without existing and disposable funds to cover payment.
