Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 812

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The inclusion of reasons in the decision to close the case. Not required by the legislature. These reasons cannot be ascertained through inference or conjecture; rather, they must be expressly recorded. The existence of a memorandum by a public prosecutor cancelling the felony number, registering the papers under a complaint number, and administratively closing them. Does not suffice as reasons.
