Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 814

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A decision definitively closing the investigation. Must be recorded in writing, explicit in its terms, and indicate that the action will not proceed. - The Public Prosecution's failure to issue a closure decision concerning an accused person in a felony does not imply its closure, nor is there any impediment to bringing it against him when it brings the action against one of the accused persons. - The Prosecution's request to impose an administrative penalty on the accused does not prevent it from bringing a criminal action against him so long as it has not issued a written order closing the investigation.
