State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insured's right to compensation for liability for an accident, arising by operation of law from the harmful act, is what passes to the insurer that paid the insurance amount to the insured or the injured party. - 236 - Right - The subrogation action brought by the insurer against the third party responsible for the accident. It is not considered to arise from the insurance contract. It is not subject to the three-year limitation period stipulated in Article 807 of the Civil Code, but is time-barred after the same period as the insured's action. Its period begins not on the date of payment of the insurance amount, but on the date on which it began to run in respect of the insured.
