Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1122

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Abandonment entailing the barring of an action under Islamic Sharia is leaving the property while grounds for an action exist because another has usurped it, encroached upon it, and denied its owner's right. The barring of the action is not based on invalidity of the right; rather, it prohibits the judge from hearing it while the right remains with its holder, so that if he acknowledges it, it binds him. - 238 - Right - The debtor's acknowledgment of the creditor's right. Its effect. Interruption of prescription and commencement of a new prescription period running from the time the acknowledgment is made. What is meant by it. The acknowledging person's admission of a right owed by him to another and treating this right as established against him. Its implication. Exempting the person in whose favor the acknowledgment is made from proving it. Acknowledgment may be express or implied and requires no particular form; any expression of will signifying acknowledgment of the debt suffices to convey it. Interruption of prescription. Its effect. Extinction of the acknowledgment, and the elapsed period becomes as though it had never existed and is disregarded in calculating the new prescription period. The general rule is that this prescription remains identical in duration and nature to the first prescription that was interrupted.
