State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The arbitrator’s jurisdiction. Derived from the litigants’ agreement to appoint him as arbitrator. - Conclusion of an arbitration agreement by a person acting as representative of another. It must be under a special, not a general, power of attorney. The reason therefor. An arbitration agreement is an act of disposition signifying waiver of bringing an action before the courts, whereas a general power of attorney confers authority on the agent only for administration.
