English translation of the principle

An arbitration agreement may take the form of a submission agreement concluded after the dispute has arisen or a clause concerning disputes that may arise in the future. The law does not require a particular form for an arbitration clause or submission agreement. The contracting parties may draw it up in any form they wish, without being bound by any particular words, provided that its terms are clear and reveal their intention to waive recourse to the courts and settle the dispute through arbitration. The effect of this. - A conciliator does not adjudicate a dispute. Rather, he assists its parties, through good offices, in reaching an amicable settlement between them, without having authority to impose any solutions he proposes to them. The parties may accept them or disregard them and resort to the courts or any other avenue.
