English translation of the principle

The direct actor in Islamic jurisprudence. What is meant thereby. One whose act, which he personally performed, brought about the damage and caused it without an intermediary, that is, without anything intervening between this act and the damage directly resulting, and it is what was the cause of the matter but did not bring it about of itself. - Establishment that the damage did not result directly from the bus in which the appellants' predecessor in title was riding, but from the impact caused to it by the truck. Effect. The bus is not considered the direct actor causing the damage, and its owner company is also exempted from its liability as carrier because the fault of a third party is established. Article 233, Civil Code. - 706 - Obligation
