Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4246

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Conditions relating to forfeiture that must be displayed distinctly from the other conditions of the insurance policy: those conditions involving a sanction for the insured's breach of the policy conditions, intended to deter him and safeguard the insurer's interests, rather than the exclusions agreed upon by the parties to the insurance contract. The rationale thereof. The challenged judgment's conclusion that the exclusions clause in the policy was a forfeiture clause, and its ruling obliging the insurer to pay compensation on the ground that it had not been displayed distinctly. An error in applying the law requiring its cassation.
