Kuwait Court of Cassation principle number 868

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that fruits belong to the owner or the person holding the usufruct over the thing. The exception. The good-faith possessor's right to fruits he receives and benefits he obtains. The possessor is deemed to act in good faith until the contrary is proved. He becomes a bad-faith possessor if an action is brought against him indicating that the right he claims over the thing he possesses does not belong to him. He is deemed such from the time he is served with the statement of claim, even if he continues to believe that he holds a right. Example.
