English translation of the principle
Common property that cannot be divided in kind, or whose division in kind the court finds would substantially diminish its value. The court may order that property sold by public auction and the price divided among the co-owners, each in proportion to that co-owner’s share therein. Article 836 of the Civil Code.

المال الشائع الذي لا يمكن قسمته عيناً أو يتبين للمحكمة أن قسمته عيناً تنقص من قيمته كثيراً. للمحكمة أن تحكم ببيع ذلك المال بالمزاد العلني وقسمة الثمن على الشركاء كل بنسبة حصته فيه. م ٨٣٦ مدني.Original Arabic judgment citations
