Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4231

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Co-holders of a usufruct right. Each one's right to claim the yield of his share from whoever is proven to have enjoyed its use. - A government house. Its allocation in equal halves. One of the two allottees leasing all its units. The other's right to claim half the rent. This is not altered by the prohibition on leasing government houses under Prime Minister's Decision No. 1116/1989 concerning housing welfare. The reason therefor. The absence of a provision prescribing nullity as the sanction for its violation. The lease remains valid and effective between its parties until the Public Authority for Housing Welfare takes such measures as it sees fit. The right to recourse for the yield remains as long as the usufruct right subsists. Contravening this. An error in the application of the law.
