Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4283

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Disposition of common property. Its condition. That the majority consist of at least two co-owners. A single co-owner may not undertake an act reserved to the majority, however large his share. The reason therefor: what matters is the plurality of opinions. - It being established that the appellant’s request for a judgment erasing and cancelling registration of the contract insofar as it contained the sale of his share in the real estate is, in substance, a request that the instrument be declared ineffective against him insofar as it contained the respondent’s acquisition of the appellant’s share, for lack of the majority. The judgment’s characterization of the action as an objection to the majority’s notification of the disposition of the real estate and its determination thereof on that basis. An error in application which prevented it from determining the appellant’s claims in their true nature.
