Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 511

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Loss of hearing warrants full diyah. Loss of hearing in one of two hearing ears warrants half a diyah. Mere impairment of the hearing function in one or both ears does not warrant diyah. Rather, judicially assessed equitable compensation is required.
