Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 664

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The independence of the suretyship contract from the original debt contract in its parties and subject matter. The effect thereof. The inapplicability of the arbitration clause contained in the latter contract to the suretyship contract unless the surety accepts or ratifies it. The courts have jurisdiction to hear the dispute concerning both contracts because they are indivisibly connected, to prevent conflicting judgments.
