State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The relative effect of litigation procedures. Its implication is that a challenge benefits only those who brought it within the time limit and may be invoked only against those against whom it was brought within the time limit. - Actions whose subject matter is indivisible or a joint and several obligation, or in which the law requires particular persons to be joined. Multiple parties against whom judgment is rendered in any such action, with only one or some of them challenging the judgment - 57 - Civil Procedure within the time limit, while the time limit has expired for the others or they have accepted the judgment. They may nevertheless join the challenger in his timely challenge; if they do not, the court must order the challenger to join them as parties. The rationale for this exception. The same rule applies to a joint and several obligation even if its subject matter is divisible. Example.
