Kuwait Court of Cassation principle number 3841

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The trial court. Its obligation to address every defence advanced by a litigant whenever it is material. Its failure to do so. Vitiates its judgment by inadequacy. - The appellant's insistence in its defence that the medical condition of the respondent's worker does not fall within the occupational or industrial diseases specified by the Private Sector Labour Law and according to what the Ministry of Social Affairs and Labour prepares, and the challenged judgment's failure to examine and scrutinize this defence although it is a material defence whose examination, if valid, would alter the view taken of the action. Vitiates it by inadequacy of reasoning and requires its cassation.
